Med-mal reform bill to hit committee today

Members of the Senate Healthcare and Medical Liability Reform Committee will consider a bill today that would make it more difficult for patients to sue emergency room physicians for negligence.

The measure, S1018, raises the bar of proof to “clear and convincing” evidence in medical malpractice cases against emergency room physicians.

Sen. Carolyn Allen, a Republican from Scottsdale, has attempted unsuccessfully to move the bill through the process in each of the past three years. Allen and other supporters of the measure are counting on the political shift in the Legislature following the 2008 elections and the succession of a Republican to the Ninth Floor to pass the bill this session.

The bill is first on the docket for the committee hearing.
