Ariz. ruling limits appeal on class-action cases

The Arizona Supreme Court is making it harder to press class-action lawsuits on behalf of groups of plaintiffs.
A unanimous ruling issued by the state high court on Aug. 24 says lawsuit plaintiffs cannot routinely appeal trial judge’s denial of class-action status for cases. That could make it uneconomical for some plaintiffs to proceed with their cases on an individual basis.
The ruling overturns a 1972 decision by the current justices’ predecessors and says the new ruling is based partly on a subsequent holding by the U.S. Supreme Court.
The ruling comes in a lawsuit in which a truck driver claimed that Swift Transportation Co. of Phoenix engaged in a pattern of underpaying drivers for miles driven.
