The controversy centers around mailers that the Re-Elect Joe Arpaio 2012 campaign sent out last year that blasted County Attorney candidate Rick Romley before the August Republican primary election.
Attorneys for Romley argued that the mailer and a TV ad were “in-kind contributions” to Romley’s opponent, Bill Montgomery, who won the election. The ads called for support for Arpaio — who’s not up for re-election until 2012 — and criticized Romley without mentioning Montgomery’s name.
The Arizona Republic says county Elections Director Karen Osborne has 30 days to determine whether she will accept the recommendations or modify them. The Arpaio committee also can appeal the decision.
