County seeks dismissal from suit against Arpaio

Maricopa County has asked a judge to dismiss it from the U.S. Justice Department’s lawsuit that alleges racial profiling by Sheriff Joe Arpaio’s office.

The county says it should be dismissed from the lawsuit against Arpaio’s office because the Justice Department is seeking to hold the county accountable for matters beyond its legal authority.

Lawyers for the county argue that the county has no authority in establishing Arpaio’s law enforcement policies.

The Justice Departments contends the county is responsible for ensuring that its allocation of money it receives from Washington and distributes for county programs complies with federal law.

Arpaio’s office is accused of racially profiling Latinos in its trademark immigration patrols and punishing Latino jail inmates with limited English skills for speaking Spanish.

The sheriff has denied the allegations.
