Bill targets power of HOAs in Arizona

house-neighborhood-620The Arizona House of Representatives will debate a bill that would significantly reduce the power of HOAs.

Republican Rep. Michelle Ugenti of Scottsdale has revived HOA regulations that became law last year but which were gutted after activists filed a lawsuit.

The lawsuit challenged the constitutionality of lumping those regulations with an elections bill that Ugenti sponsored. That bill became a law but was later gutted of all but one of the HOA provisions after homeowner activists sued the Legislature.

A new bill this year targets HOA regulations in part by banning local governments from forcing developers to establish HOAs in new subdivisions. The Senate approved an identical bill on Feb. 27.

The House will debate House Bill 2695 on Thursday.

  1. So what does this actualy do? I mean no info at all makes me worry this is just a bill that says you don’t have to make an HOA, but they can still do x, and y freely…
