NOTICE OF HEARING ON PETITION FOR TERMINATION OF PARENT-CHILD RELATIONSHIP

In Re the Matter of: ROMAN ALEX GALLARDO, DOB 11/07/2009, A person under the age of 18 years.
TO: STEVEN J. LOPEZ, OMAR (surname unknown), JOHN DOES, and any other male claiming to be the father of the above-named child and ERICA ADRIANA GALLARDO, birth mother:
1. Petitioners, MARTIN GUZMAN and DINORA G. GUZMAN, have filed with this Court their verified Petition for Termination of Parent-Child Relationship between STEVEN J. LOPEZ, OMAR (surname unknown), and JOHN DOES, Potential Fathers, and ROMAN ALEX GALLARDO, the minor child, pursuant to A.R.S. §§8-531(1) and 8-533(B)(1), (4) and (6).
2. NOTICE IS GIVEN that the above Petition for Termination of Parent-Child Relationship is set for an initial hearing on the 7th day of March, 2011, at 10 A.M. before the Honorable Comm. Owens in the Juvenile Division of the Maricopa County Superior Court, at the Southeast Facility, 1810 S. Lewis Street, Mesa, AZ 85210-6234, for the purpose of determining whether STEVEN J. LOPEZ, OMAR (surname unknown), and JOHN DOES, potential fathers are contesting the allegations in the Petition for Termination.
3. Notice of the hearing shall be given to all persons required pursuant to A.R.S. §8-535, as amended, at least ten (10) days prior to said date.
4. You have a right to appear as a party in this proceeding. You are advised that your failure to appear at the initial hearing, pretrial conference, status conference or termination adjudication hearing, without good cause, may result in an adjudication terminating the parent-child relationship of that parent. If a parent does not appear at the initial hearing, the court, after determining that the parent has been served with proper legal notice, may find that the parent has waived the parent’s legal rights and is deemed to have admitted the allegations of the petition by the failure to appear. The hearings may go forward in the absence of the parent, guardian or Indian custodian and the court may terminate the parent-child relationship as to a parent who does not appear based on the record and evidence presented as provided in the rules prescribed by the supreme court.
5. In the event you appear and contest the allegations, a pretrial conference or status conference and termination adjudication hearing will be scheduled.
6. If you are receiving this notice by publication, you may obtain a copy of the Notice of Initial Hearing on Petition for Termination of Parent-Child Relationship and the Petition for Termination of Parent-Child Relationship by contacting attorney Logan F. Boren, either in writing or by telephone, at 1108 E. Greenway, Suite 1, Mesa, AZ 85203, 480-844-8485.
7. At the initial hearing an attorney will be appointed to represent any parent named herein if they want a lawyer and they cannot afford to hire their own. That parent will be required to sign a financial affidavit and may be required to pay a portion of the cost of the attorney.
8. A request for reasonable accommodation for persons with disabilities must be made to the court by the parties at least three (3) working days in advance of a scheduled court proceeding.
