State lawmaker’s trial pushed back to July

State Sen. John Huppenthal’s trial on misdemeanor charges of theft and tampering with a campaign sign has been pushed back until July.

Huppenthal’s attorney Booker Evans has asked that the senator not go to trial until after the legislative session in accordance with the state Constitution.

But Booker says the prosecution also wants to reschedule to accommodate police officers involved in the case.

The trial was originally slotted to begin June 25. It’s now on the docket for July 29 in San Marcos Justice Court.

Huppenthal, R-Chandler, has been charged in an Election Day incident in which a 78-year-old Democratic activist told reporters that the senator cut down one of the party’s signs and struggled with her over it before driving off.

Huppenthal claims the property owner gave him permission to remove the sign.
