The Arizona Supreme Court has been asked by Tucson attorneys for permission to remove 89 billboards that violate city regulations.
But a lawyer for Clear Channel Outdoor Inc. argued Nov. 4 that city efforts to remove the signs violate the statute of limitations under a state law limiting the city’s ability get rid of billboards on many streets.
The attorneys made their arguments at a special session of the state Supreme Court at the University of Arizona College of Law as part of a program to increase public access to the court.
The justices gave no indication of when they will rule on the case.
The 2000 law requires the city to file a complaint about an illegal billboard within two years after a violation is discovered.
Although the city issued violation notices for the 89 billboards before the 2000 law was adopted, Clear Channel attorney John Munger argued that the two-year statute of limitations included in the law should be applied retroactively. —
