H2146 is a harmless bill that has now been subjected to a strike everything amendment, the worst of all political maneuvering with controversial topics, and now strongly affects how HOAs conduct business.
Please give the following to your sixth grader to calculate the numbers. The amendment excerpt shown below, affecting ARS 33-1243 and 33-1813, was taken from Community Association Institute’s failures in 2002 and 2003 with the same stupid math. Why aren’t our legislators alert to this mockery of state laws≠
For purposes of calling for removal of a member of the board of directors, the following apply:
1. In an association with 1,000 members or fewer, on receipt of a petition that calls for removal of a member of the board of directors and that is signed by the number of persons who are entitled to cast at least 25 per cent of the votes in the association, the board shall call and provide written notice of a special meeting of the association as prescribed by section 33-1248, subsection B.
2. Notwithstanding section 33-1248, subsection B, In an association with more than 1,000, on receipt of a petition that calls for removal of a member of the board of directors and that is signed by the number of persons who are entitled to cast at least 10 per cent of the votes in the association, the board shall call and provide written notice of a special meeting of the association. The board shall provide written notice of a special meeting as prescribed by section 33-1248, subsection B.
For your convenience:
10% of 1,001 = 100 members
for a quorum
25% of 1,000 = 250 members
25% of 400 = 100 members
Therefore, HOAs with 401 to 1,000 members are subjected to a penalty and disproportionate quorum requirement. I understand that lawyers don’t understand math, but how about our legislators≠ Who’s looking out for the people of this state≠
Maybe the legislators should think about who controls their pay raises — voted down in the past two elections. Maybe they will get an increase when they begin to realize that they represent the people and not the special interests! —
