Tucson lawyer disbarred for conflict of interest violations

The Arizona Supreme Court has disbarred a Tucson attorney who surrendered his license last year.
The court moved to disbar Mark S. Clark after the Massachusetts Supreme Court disbarred him in August for misconduct committed before he moved to Arizona in 1997.
The Massachusetts court said Mr. Clark mishandled client funds, charged excessive and improper fees for future services and got involved in a business transaction with a client without the client’s consent.
In both disbarments, Mr. Clark challenged the constitutionality of the procedure because he gave up his law license before the courts took action.
In 2002, the Arizona Supreme Court suspended Mr. Clark’s license for three years for violating conflict of interest rules, making untruthful statements, failing to pay required fees, failing to respond to a State Bar inquiry and refusing to cooperate.
Clark was ordered to pay $58,000 to a couple he represented and other costs.
