In cases where the death penalty is sought, if the jury cannot reach a unanimous decision to impose the death penalty, a new jury, instead of the judge, must determine if the sentence should be life or natural life. The Arizona Innocence Inquiry Commission is established to conduct inquiries into claims of factual innocence. A process for these inquiries is established, including a requirement that the convicted person waive procedural safeguards and privileges and a way to notify the victims. If a majority concludes that there is evidence of factual innocence in a case with a not guilty plea, or if it is unanimous in a case with a guilty plea, a three judge panel is appointed to hold a special hearing. If the panel unanimously determines innocence by clear and convincing evidence, some or all charges may be dismissed. Claims of factual innocence must be filed by December 31, 2011. A state board of directors for community colleges is established consisting of one member from each of the 15 counties, a representative from the Arizona Board of Regents, and the Superintendent of Public Instruction. The board has jurisdiction over community college districts similar to the jurisdiction of the Arizona Board of Regents over state universities, and takes over many responsibilities previously delegated to the districts, including finances, admissions qualifications, curriculum, tuition, qualifications for staff, and determining the location of community colleges. Community college districts must obtain board approval before taking certain actions previously under their control. The board is considered a state agency and is an annual budget unit. All property of community college districts and all bond obligations are transferred to the board on the effective date of the bill.
